These General Terms of Service (“General Terms”) govern your access to and use of TuxlerVPN Mobile, including all associated services, applications, and software (collectively, the “Service” or “Services”). These General Terms also apply to your access and use of the TuxlerVPN Mobile website (the “Website”).

By accessing or using TuxlerVPN Mobile, you acknowledge and agree to be legally bound by these Terms. If you do not accept these Terms, you must not use our Services. It is your responsibility to read, understand, and regularly review these Terms to ensure compliance.

1.2 Subscription

TuxlerVPN Mobile provides its paid Services on a subscription basis, meaning that your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. Subscription pricing, terms, and available features may vary by plan and region. 1.3 Legal Jurisdiction

For the purpose of these Terms, “TuxlerVPN Mobile,” “we,” “us,” or “our” refers to Tuxler Digital Services Corp., World Trade Center 200-B, Suite 157, Calle 53 Este, Marbella, PA, Republica de Panama, a company registered and operating under Panamanian law.

2. Your Agreement with TuxlerVPN Mobile

2.1 Binding Legal Agreement

These General Terms establish a legally binding agreement between you (or any entity you legally represent) and TuxlerVPN Mobile. By downloading, installing, or using our Services, you expressly agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2.2 Age Requirement

You must be at least 18 years old to access and use TuxlerVPN Mobile. By using our Services, you confirm that you meet this requirement.

2.3 Updates to Terms

TuxlerVPN Mobile reserves the right to modify or update these Terms to reflect:

• Changes in laws or regulations
• Security improvements
• Introduction of new features
• Modifications to subscription models

We will notify users in advance of any material changes via reasonable means such as email or in-app notifications. Your continued use of the Services after such updates constitutes your acceptance of the revised Terms.

3. Services

3.1 Access to Services

TuxlerVPN Mobile provides both free and paid VPN services that encrypt internet traffic and protect users’ privacy. These General Terms apply to all versions of our Services.

3.2 Compliance with Legal Regulations

TuxlerVPN Mobile operates under Panamanian law and adheres to applicable global privacy regulations, including but not limited to:

• United States (U.S.): Digital Millennium Copyright Act (DMCA), applicable state laws, and export regulations.
• General Data Protection Regulation (GDPR): Effective May 25, 2018 (EU)
• California Consumer Privacy Act (CCPA): Effective January 1, 2020 (USA)
• UK General Data Protection Regulation (UK GDPR): Effective January 1, 2021 (UK)
• Personal Information Protection and Electronic Documents Act (PIPEDA): Effective April 13, 2000 (Canada)
• Personal Data Protection Acts (PDPA) in Singapore, Thailand, and the Philippines

4. Access to the Service

4.1 No TuxlerVPN Mobile Account Required

TuxlerVPN Mobile does not require you to register an account, provide an email address, or set a password to use the Android app. Free-tier sessions are authenticated using built-in default credentials shared by all free users, and you do not create or receive personal credentials from us. As a result, TuxlerVPN Mobile does not operate a sign-in system, password recovery process, or multi-factor authentication mechanism for end users.

4.2 Google Play Account

To download the App and to purchase, manage, or cancel a premium subscription, you must use a Google Play account. Your Google Play account is governed by Google’s terms and policies, not by these Terms. You are responsible for maintaining the security of your Google Play account and for all activity conducted through it. If you suspect unauthorized access to your Google Play account, you must notify Google LLC.

4.3 Premium Entitlement Verification

When you connect to a premium VPN server, the App sends your Google Play Billing purchase token to our backend at apivpn.tuxlervpn.app solely to verify your subscription status, as described in our Privacy Policy. We do not issue you separate TuxlerVPN Mobile credentials in connection with this verification.

5. Subscription & Auto-Renewals

5.1 Subscription Services

TuxlerVPN Mobile operates on a monthly subscription basis for its premium plan. You may choose your preferred billing cycle at the time of purchase.

5.2 Auto-Renewal

Your subscription will automatically renew unless you cancel it before the renewal date on the Google Play Store. Your chosen payment method will be charged the then-current rate for your selected plan.

5.3 Cancellation & Refunds

30-day money-back guarantee: If you are not satisfied, you can request a full refund within 30 days of purchase.

Once a subscription renews, it will not be eligible for a refund unless required by applicable law.

6. Acceptable Use Policy

6.1 Prohibited Activities

You agree not to use TuxlerVPN Mobile for:

• Engaging in illegal activities such as hacking, fraud, or cyberattacks
• Hosting or distributing child exploitation materials
• Distributing malware, phishing, or spam
• Conducting unauthorized penetration testing or security scanning
• Disrupting networks, launching DDoS attacks, or interfering with other users
• Engaging in cyber warfare or unlawful surveillance
• Violating intellectual property rights or applicable laws

6.2 Fair Usage

TuxlerVPN Mobile reserves the right to suspend or terminate your access to the Service, and to refuse to verify your premium subscription, if you violate our Acceptable Use Policy.

7. Disclaimer of Warranties

TuxlerVPN Mobile is provided “as-is” and “as-available” without any warranties, either express or implied, including but not limited to:

• The availability, reliability, or security of the VPN service
• The accuracy of information transmitted through our servers
• Any guarantee of uninterrupted service
• We do not warrant that our Services will always be available, uninterrupted, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, TuxlerVPN Mobile shall not be liable for:

• Any loss of data, financial losses, or service interruptions
• Any indirect, incidental, punitive, or consequential damages
• Unauthorized access to your personal information

9. Governing Law & Dispute Resolution

9.1 Legal Jurisdiction

These Terms are governed by the laws of Panama. Any disputes must be resolved in Panamanian courts.

9.2 Arbitration & Class Action Waiver

Where applicable, disputes must be resolved through binding arbitration. Users waive their right to participate in class-action lawsuits.

10. Termination & Suspension

10.1 Suspension of Services

TuxlerVPN Mobile reserves the right to suspend or terminate your access to the Service, including refusing to verify a premium subscription, if you violate these Terms or applicable laws.

10.2 User Termination

You may stop using the Service at any time by uninstalling the App. You may end a premium subscription at any time by canceling it through your Google Play account. Cancellation timing is governed by Google Play’s policies.
