ACCEPTABLE USE POLICY (AUP)
1. INTRODUCTION
Tuxler Digital Services Corp. (“TuxlerVPN Mobile,” “we,” “us,” or “our”) is committed to providing a secure, private, and reliable VPN service to its users while ensuring compliance with applicable laws and ethical standards. This Acceptable Use Policy (AUP) outlines prohibited activities and governs the use of TuxlerVPN Mobile’s services (“Services”).
By accessing or using our Services, you agree to abide by this AUP. Failure to comply may result in the suspension or termination of your access to the Service (including refusal to verify a premium subscription) without refund, and in certain cases, legal action may be taken.
TuxlerVPN Mobile operates under the laws of Panama, and we also adhere to applicable international regulations in jurisdictions where we provide Services, including but not limited to:
- United States (U.S.): Compliance with the Digital Millennium Copyright Act (DMCA), Computer Fraud and Abuse Act (CFAA), and other federal/state laws.
- European Union (EU): Adherence to the General Data Protection Regulation (GDPR) and cybersecurity directives.
- United Kingdom (UK): Compliance with the UK Data Protection Act and the Investigatory Powers Act.
- California (U.S.): Compliance with the California Consumer Privacy Act (CCPA).
- Asia-Pacific: Observance of local data protection laws, including those in Japan, Singapore, South Korea, and Australia.
This AUP applies to all users, including individual and business subscribers.
2. PROHIBITED USES
You must not use TuxlerVPN Mobile’s Services for any activity that is unlawful, harmful, or unethical. The following activities are strictly prohibited:
2.1 Illegal Activities
You must not use TuxlerVPN Mobile to engage in, facilitate, or promote any criminal or illegal activities, including but not limited to:
- Accessing, distributing, or storing child exploitation material.
- Hacking, unauthorized penetration testing, or any form of unauthorized access to computer networks.
- Financial fraud, including identity theft, credit card fraud, wire fraud, and Ponzi schemes.
- Selling or distributing stolen credentials, hacking tools, or malware.
- Engaging in terrorist activities, arms trafficking, or other prohibited activities under international law.
- Violating any applicable export control laws or using the Services in embargoed countries.
2.2 Copyright and Intellectual Property Violations
Users must not engage in copyright infringement, including:
- Unauthorized downloading, distribution, or streaming of copyrighted content (movies, TV shows, music, books, software, etc.).
- Circumventing Digital Rights Management (DRM) protections.
- Hosting or distributing pirated software, cracked applications, or illegal streaming services.
- Violating the Digital Millennium Copyright Act (DMCA).
2.3 Spam, Phishing, and Fraudulent Activities
TuxlerVPN Mobile must not be used for any of the following:
- Sending spam emails, bulk unsolicited messages, or commercial solicitations.
- Conducting phishing attacks, impersonation, or fraudulent schemes.
- Harvesting personal information, including usernames, passwords, and financial data.
- Distributing malware, viruses, trojans, or any malicious code.
2.4 Cybersecurity Threats & Network Abuse
Users must not engage in activities that disrupt, interfere with, or compromise network security, including:
- Distributed Denial-of-Service (DDoS) attacks.
- Network sniffing, port scanning, or surveillance of third-party systems.
- Manipulating VPN connections for traffic redirection, unauthorized proxy services, or botnets.
- Using the Services to evade government censorship in violation of applicable laws.
2.5 Resale, Unauthorized Sharing, and Subscription Abuse
You may not:
- Resell, redistribute, or sub-license TuxlerVPN Mobile services without authorization.
- Use multiple Google Play accounts or installations to circumvent restrictions or abuse promotional offers.
2.6 Fair Usage Policy
To maintain quality service, users must adhere to our fair usage policy:
- Excessive bandwidth consumption that negatively impacts network performance is prohibited.
- Automated activities (e.g., web scraping, excessive API requests) are restricted unless approved.
- Business users must comply with our business usage terms.
3. ENFORCEMENT & CONSEQUENCES
TuxlerVPN Mobile reserves the right to monitor, investigate, and take action against any violation of this AUP. Actions may include:
- Immediate suspension or termination of access to the Service without refund (including refusal to verify a premium subscription on future connection attempts).
- Blocking access to specific services, servers, or IP addresses.
- Cooperation with law enforcement agencies when required by legal process.
- Legal action if violations result in damages to TuxlerVPN Mobile or third parties.

4. USER RESPONSIBILITIES & LIABILITY
By using TuxlerVPN Mobile, you acknowledge and agree that:
- You are solely responsible for your actions while using our Services.
- You will comply with all applicable laws and regulations in your jurisdiction.
- TuxlerVPN Mobile assumes no liability for user misconduct or third-party actions taken via our Services.
5. MODIFICATIONS TO THIS POLICY
TuxlerVPN Mobile reserves the right to modify or update this AUP at any time to reflect legal, technological, or business changes. Material updates will be communicated via email or website notification. Continued use of the Services constitutes acceptance of the revised AUP.
