END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Tuxler Digital Services Corp., World Trade Center 200-B, Suite 157, Calle 53 Este, Marbella, PA, Republica de Panama, a company incorporated in Panama (“TuxlerVPN Mobile,” “Company,” “we,” or “us”), governing your use of the TuxlerVPN Mobile App (“App”) distributed solely via the Google Play Store.

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not download, install, or use the App.

1. LICENSE GRANT

TuxlerVPN Mobile grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely on Android devices you own or control and only as permitted by Google Play’s Terms of Service. This license is granted strictly for personal, non-commercial use unless otherwise agreed in writing.

2. RESTRICTIONS

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Modify, adapt, translate, or create derivative works of the App.
  • Rent, lease, lend, sell, redistribute, sublicense, or make the App available over a network or otherwise to multiple users.
  • Use the App for any unlawful, infringing, harmful, fraudulent, or offensive purpose.
  • Circumvent or attempt to defeat any security or usage rules embedded in the App.

You have to refer to our Acceptable Use Policy to have the full knowledge of the restrictions under the EULA of TuxlerVPN Mobile for Android.

3. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in and to the App, including but not limited to its software code, UI design, trademarks, and all related documentation, are owned by or licensed to TuxlerVPN Mobile. This Agreement does not grant you any rights in or to such intellectual property except as explicitly stated.

4. SUBSCRIPTIONS

The App does not require you to register a TuxlerVPN Mobile account. Free-tier sessions are authenticated using built-in default credentials. Premium features require a paid subscription managed through your Google Play account. You agree to:

  • Use your Google Play account in accordance with Google’s terms.
  • Abide by applicable Google Play Billing Terms.
  • Understand that auto-renewable subscriptions may renew unless canceled at least 24 hours before the end of the billing cycle.

Refunds for subscriptions are governed by our Refund Policy and by Google Play’s refund policies.

5. PRIVACY

Your privacy is important to us. Our data collection and processing practices are governed by our Privacy Policy, which is aligned with:

  • General Data Protection Regulation (GDPR), EU.
  • UK Data Protection Act 2018.
  • California Consumer Privacy Act (CCPA) and Children’s Online Privacy Protection Act (COPPA), US.

By using the App, you consent to our processing of your data as outlined therein.

6. THIRD-PARTY SERVICES

The App may integrate or link to services provided by third parties. TuxlerVPN Mobile is not responsible for the content, policies, or practices of such third parties. Use of third-party services is subject to their terms.

7. TERMINATION

We may suspend or terminate this Agreement and your license at any time without notice if:

  • You violate any term of this Agreement.
  • Required by applicable law.
  • The App is withdrawn from the Google Play Store.

Upon termination, you must uninstall and cease all use of the App.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
  • TuxlerVPN Mobile disclaims any warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not guarantee uninterrupted, error-free, or secure operation of the App.

Limitation of Liability: Under no circumstances shall TuxlerVPN Mobile be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the App.

9. COMPLIANCE WITH LAW

You agree to comply with all local, national, and international laws and regulations applicable to your use of the App, including export control laws, sanctions, and data protection rules.

10. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of Panama, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Panama, unless otherwise required by applicable consumer protection laws in your country of residence (e.g., EU/UK).

11. ENTIRE AGREEMENT

This Agreement, along with our Privacy Policy and any other legal notices published on the TuxlerVPN Mobile website or within the App, constitutes the entire agreement between you and TuxlerVPN Mobile regarding the App.

12. CHANGES TO THIS AGREEMENT

We reserve the right to modify this Agreement at any time. Updates will be posted within the App and on our website. Your continued use of the App after such modifications constitutes your acceptance.
